ARTICLE XII
TIERED ANNUITY CONTRIBUTION

Section 1. Effective June 1, 1996, the Plan may receive tiered annuity contributions from Covered Employees as set forth in Appendix A to the 2002 Restatement of the Southern California IBEW-NECA Defined Contribution Plan. Such contributions shall be added to a Covered Employee's Individual Account and shall only be permitted if the jurisdiction in which the Covered Employee is employed has adopted language in the collective bargaining agreement permitting classifications and tiered annuity contributions pursuant to such classifications. No further tiered annuity contributions beyond those specified in Appendix A to the 2002 Restatement of the Southern California IBEW-NECA Defined Contribution Plan shall be received by the Plan.
