AMENDMENT NO. 40
TO THE
SOUTHERN CALIFORNIA IBEW-NECA ACTIVE HEALTH PLAN

Effective February 4, 2009, the second paragraph under the Section entitled "Lifetime Maximum" on page 71 of the Southern California IBEW-NECA Health Plan Summary Plan Description for Eligible Active Participants and Eligible Dependents is hereby deleted.

Approved and adopted at the meeting of the Board of Trustees of the Southern California IBEW-NECA Health Trust Fund held on February 4, 2009.
