This Amendment to the Southern California IBEW -NECA Pension Plan ("Plan") executed this 27th day of April, 2010, is made by the Board of Trustees of the Southern California IBEW-NECA Pension Trust Fund ("Board of Trustees") with reference to the following facts and circumstances:

1. The Board of Trustees wishes to amend the terms of the Plan so that upon conversion of either a Partial Disability or Early Retirement Pension to a Total and Permanent Disability Benefit effective on or after July 1, 2010, the Total and Permanent Disability Benefit benefit is a nonauxiliary benefit and so that the payment of the Total and Permanent Disability Benefit shall be made in the same form of payment that was elected upon Partial Disability or Early Retirement.
2. The Board of Trustees has reserved to themselves the ability to amend the Plan from time to time.

NOW THEREFORE, the Plan is amended as follows:

1. Article 7, Section 7.5 is amended by adding the following to the end of the section:
   
   "For a Pensioner who on or after July 1, 2010 provides the Trustees acceptable evidence under Section 7.1 that he qualifies for a Total and Permanent Disability Benefit and whose Partial Disability Benefit under this section is subsequently converted to a Total and Permanent Disability Benefit, his Total and Permanent Disability Benefit shall be determined under the terms of Section 7.11(b)."
   
   
2. Article 7, Section 7.13 is amended by adding the following to the end of the section:
   
   "For a Pensioner who on or after July 1, 2010 provides the Trustees acceptable evidence under Section 7.1 that he qualifies for a Total and Permanent Disability Benefit and who subsequently elects to convert his Early Retirement Benefit under this section to a Total and Permanent Disability Benefit, his Total and Permanent Disability Benefit shall be determined under the terms of Section 7.11(b)."
   
   
3. All other terms and conditions of the Plan shall remain in full force and effect.

This Amendment shall be effective July 1, 2010.
