Southern California IBEW-NECA Retiree Health Plan

AMENDMENT NO. 8
To The
Southern California IBEW-NECA Retiree Health Plan

Effective October 1, 2006, the section entitled “ Legal Spouse” on page 29 of the Southern California IBEW-NECA Retiree Health Plan under the heading COBRA” is deleted in its entirety and replaced with the following:

FIVE FEDERAL LAWS YOU SHOULD KNOW ABOUT

COBRA

Legal Spouse:
If you are the legal spouse of the retiree covered for benefits under the Retiree Health Plan and you would lose coverage due to a qualifying event such as divorce or legal separation from the retiree you may elect COBRA continuation for up to 36-months.

If you experience a qualifying event as described above, you must notify the Administrative Office in writing within 60 days of the date of the final decree of divorce or legal separation. In such event, your coverage will terminate on the first of the month following the month of divorce, subject to the exception in the proceeding paragraph, unless COBRA continuation coverage is timely elected .

Failure to give timely notice of a divorce or legal separation to the Administrative Office shall result in a denial of COBRA continuation coverage and may subject the Retiree and former spouse to damages as a result of any premiums paid on an ineligible former spouse’s behalf and/or benefits paid or reimbursement provided by the Trust Fund. Furthermore, with regard to any conversion rights available to a former spouse, the affected HMO shall have the ability in its sole discretion to define whether those conversion rights apply to a former spouse who was not eligible for COBRA due to the lack of timely notification of death or divorce provided to the Trust Fund.

Effective October 1, 2006, the Southern California IBEW-NECA Retiree Health Plan is amended in the following respect. Two new paragraph are added at the end of the section entitled ELIGIBILITY REQUIREMENTS as contained on pages 8 and 9 of the Retiree Health Plan preceding the section entitled CREDITING DISABILITY HOURS FOR RETIREE ELIGIBILITY as follows:

“If you are eligible at the time of your death, the benefits of your then eligible surviving spouse will continue until the earlier of your spouse’s death, your spouse’s coverage under some other Plan, your spouse’s failure to pay any required self-payments or the termination of the Retiree Health Plan. In no event shall benefits be provided to a subsequent spouse of your surviving spouse.

A surviving spouse under the circumstances stated above should notify the Administrative Office within 30 days of the death of the retiree so that the required monthly self-payment can be adjusted to reflect a single party rate based on a percentage of cost as applied equally to all Retirees making a self-payment to the Plan. The revised self-payment shall be effective the first of the month following the month of the death of the retiree.”
