AMENDMENT NO. 7
TO THE
SOUTHERN CALIFORNIA IBEW-NECA ACTIVE HEALTH PLAN

  1. BACKGROUND AND PURPOSE:

    Until September 1, 2005 IBEW Local 11 members working under the Southern California 9th District Sound and Communications Agreement (Sound Agreement) were reported to the Orange County IBEW-NECA Health Trust for Health and Welfare coverage. Effective for hours worked on and after September 1, 2005 Health and Welfare hourly contributions under the Sound Agreement for IBEW Local 11 members will be reported to the Southern California IBEW-NECA Health Plan.

    The Orange County Trust has advised the Southern California Plan that following the change in contributions on September 1, 2005 IBEW Local 11 members eligible for benefits under the Orange County Trust on September 1, 2005 shall be entitled to exhaust their accrued hour bank coverage under the Orange County Trust.

    The purpose of this Amendment is to provide eligible IBEW Local 11 members continuity of eligibility during this change in contributions under the Sound Agreement. Eligible Local 11 members will not be required to meet the regular initial eligibility rules of this Plan.

    A portion of this Amendment provides a special COBRA rule for IBEW Local 11 members and their dependents who due to contributions under the Sound Agreement are participating or eligible to participate in the Orange County Trust pursuant to COBRA as of September 1, 2005.

  2. ELIGIBILITY FOR CONTINUITY OF ELIGIBILITY UNDER THE SPECIAL HOUR BANK RULE OF THIS AMENDMENT:

    Local 11 members who: (i) worked under the Sound Agreement prior to September 1, 2005; (ii) were eligible under the Orange County Trust as of September 1, 2005; and (iii) work under the Sound Agreement during the month of September 2005 are eligible for the special hour bank rule of this Amendment.

    Local 11 members working under the Sound Agreement not eligible for coverage under all of the preceding standards of this Amendment must meet this Plan's regular initial eligibility standards.

    The Southern California Fund Offices has received a list of eligible Local 11 members from the Orange County Trust. If you were on that list you will be receiving a separate letter and enrollment materials for the Southern California Plan. If you believe you are eligible under the standards of this Amendment and do not receive that letter and enrollment materials you should promptly contact the Souther California Fund Offices.

    Local 11 members and their dependents granted eligibility under the special hour bank rule of this Amendment shall be subject to Amendment 18 of this Plan regarding the Section of this Plan entitled, "Initial Eligibility for Certain Employees of Certain New Contributing Employers."

  3. SPECIAL HOUR BANK RULE:

    Eligible Local 11 members' Sound Agreement hourly contributions received by this Plan while they remain eligible under the Orange County Trust will be credited to their hour bank under this Plan. Upon loss of eligibility under the Orange County Trust an additional one-time credit of hours will be added to their hour bank so that their hour bank totals 675 hours. The member and their dependents shall then be immediately eligible for benefits under this Plan. (See the Commencement Date provisions of this Amendment.)

    The eligible member's additional one-time credit of hours shall be repaid from hours subsequently reported to this Plan on behalf of the member in excess of 130 hours per calendar month. After repayment the member shall have hours reported to this Plan in excess of 130 hours for any calendar month credited to their hour bank.

  4. COMMENCEMENT DATE FOR COVERAGE:

    The Commencement Date of Coverage under this Plan for a member and their dependents eligible for special coverage under this Amendment is the first day of the month following the last month of coverage under the Orange County Trust. Each eligible member's Commencement Date thus depends upon their Hour Bank under the Orange County Trust. Members eligible for coverage under this Amendment should file enrollment materials with the Southern California Fund Offices prior to their Commencement Date to avoid any disruptions in coverage.

  5. CONTINUING ELIGIBILITY FOR BENEFITS:

    For continuing coverage under this Plan a member must be reported for 130 hours per month for coverage, or have sufficient hours in his hour bank plus reported hours to have 130 hours credited for a month. Hours withdrawn from the hour bank to obtain the 130 hours reduces the member's hour bank reserve.

  6. SPECIAL COBRA RULE:

    Some IBEW Local 11 members and/or their dependents may have participated in the Orange County Trust under the Sound Agreement and be a COBRA participant (or within the COBRA election period) under the Orange County Trust as of September 1, 2005. Should the Orange County Trust terminate or refuse COBRA coverage solely due to the change in contribution requirements under the Sound Agreement those individuals may continue the balance of their COBRA coverage under this Plan by timely payments of full COBRA premiums to this Plan.

  7. NO RETIREE HEALTH COVERAGE:

    Hours reported under the Sound Agreement or eligibility pursuant to this Amendment create no eligibility for purposes of retiree health coverage under this Plan.

    This Amendment shall be an appendix to the Plan. Approved and adopted at the Board meeting held on May 24 , 2005.
