AMENDMENT NO. 1
TO THE
SOUTHERN CALIFORNIA IBEW-NECA PENSION PLAN
This Amendment to the Southern California IBEW-NECA Pension Plan (“Plan”) executed this 28th day of January, is made by the Board of Trustees of the Southern California IBEW-NECA Pension Trust Fund (“Board of Trustees”) with reference to the following facts and circumstances:
- This Amendment is intended to provide that registration on the books at any hiring hall for employment by a private or public utility or for employment with a subcontractor to a utility, shall result in a suspension of early retirement benefits for all benefits accrued on and after July 1, 2015.
- The Board of Trustees has reserved to themselves the ability to amend the Plan from time to time.
NOW THEREFORE, the Plan is amended as follows:
- Article 9, Section 9.7(b)(2) is amended by adding the following new subsection (xvi):
"Only benefits accrued on and after July 1, 2015 shall be suspended for that month in which a Pensioner is registered on the books at any hiring hall for employment by a private or public utility or for employment with a subcontractor to a utility, whether or not such work is covered by an IBEW collective bargaining agreement, including but not limited to work to be performed under collective bargaining agreements sponsored by Locals 18, 47, and 1245." - All other terms and conditions of the Plan shall remain in full force and effect.
