Amendment No. 19
To the Summary Plan Description of the Southern California IBEW-NECA Supplemental Unemployment Benefit Trust Fund
as of January 1, 2015
This Amendment to the Southern California IBEW-NECA Supplemental Unemployment Benefit Trust Fund Summary Plan Description, for Inside Wiremen, Intelligent Transportation, and Inspectors effective as of January 1, 2015, is made by the Board of Trustees of the Southern California IBEW-NECA Supplemental Unemployment Benefit Trust Fund (“Board of Trustees“) with reference to the following facts and circumstances.
The Board of Trustees has reserved to themselves the ability to amend the Plan from time to time.
- The Board of Trustees wishes to modify Page 8 of the SPD regarding How do I file for an appliation for benefits. The last paragraph of page 8 states in part:
"In order to receive benefits an eligible Participant must file an application for benefits no later than 60 days from the day for which benefits are claimed."
In the event the California Unemployment Insurance Appeals Board ("Appeals Board") grants an appeal for unemployment benefits, the participant will have become entitled to benefits well after 60 days from the date of the participant's unemployment event. Under the current SPD, the participant's application would be untimely even though the Appeals Board granted the benefits. The trustees wish to amend the SPD to give participants who successfully appeal a denial of unemployment benefits to the Appeals Board or a Court with jurisdiction over unemployment appeals the opportunity to apply for benefits within 60 days of the final decision by the Appeals Board or higher Court of Appeals.
All other requirements for benefits shall remain the same.
NOW THEREFORE, the last paragraph of the How to I file for an aplication for benefits Section, on page 8 of the Summary Plan Description, is amended effective for benefits accrued on or after March 1, 2024, to read as follows:
"In order to receive benefits an eligible Participant must file an application for benefits no later than 60 days from the day for which benefits are claimed or 60 days from the date the California Unemployment Insurance Appeals Board or any Court with jurisdiction over California unemployment benefit Appeals grants an appeal for benefits, whichever is later."
The effective date of this Amendement shall be March 1, 2024.
All other terms and conditions of the Plan shall remain in full force and effect.
